RELEASE OF LIABILITY, WAIVER OF CLAIMS, INDEMNIFICATION, AND ARBITRATION AGREEMENT
NOTICE: By signing this document you may be waiving certain legal rights, including the right to sue. If you are uncertain of your rights or obligations under this agreement, you may wish to consult an attorney.
In consideration of being allowed to participate in certain hockey, skating, events, training camps, or other programs involving physical activity (“Programs”) at Children’s Health StarCenters and Comerica Center (collectively, the “Facility”), the below signed individual (the “Participant”), and the Participant’s parent(s), supervisor(s), or legal guardian(s) if the Participant is a minor, do hereby agree, to the fullest extent permitted by law, as follows:
1) TO WAIVE ALL CLAIMS that they have or may have against the Facility and/or the DSE Hockey Centers, L.P., DSE Hockey Club, L.P., Dallas Sports and Entertainment, L.P., the owner of the Facility, the Municipality in which the Facility is located, and any and all of their respective affiliates, owners, officers, directors, shareholders, employees, agents, volunteers, participants and the League (collectively, “Releasees”), arising out of the Participant’s participation in the Programs and/or the use of any equipment provided by the Facility and/or Releasees (“Equipment”). The Participant and his/her parents, supervisor, and/or legal guardian(s) specifically understand that they are releasing any and all claims that arise or may arise from any NEGLIGENCE or BREACH OF CONTRACT of the Facility and/or the Releasees.
2) TO ASSUME ALL RISKS of participating in the Programs and using the Equipment, even those caused by the NEGLIGENCE or BREACH OF CONTRACT of the Facility and/or the Releasees. The Participant and his/her parents, supervisors and/or legal guardian(s) understand and accepts the risks of participating in the Programs and using the Equipment may be both foreseen and unforeseen and may include serious physical injury and/or death and other personal and property damages;
3) TO RELEASE the Facility and/or the Releasees from all liability for any loss, damage, injury, death, or expense that the Participant (or his/her next of kin, associates, and/or fellow Participants) may suffer, arising out of his/her participation in the Programs and/or use of the Equipment, even those caused by the NEGLIGENCE or BREACH OF CONTRACT of the Facility and/or the Releasees; and
4) TO INDEMNIFY the Facility and the Releasees from all liability for any loss, damage, injury, death, or expense that the Participant (or his/her next of kin, associates, and/or fellow Participants) may suffer, arising out of participation in Programs and/or use of the Equipment.
5) TO PERMIT the placement of his/her name and/or photo (and/or the name/photo of his/her minor child(ren) on the DSE Hockey Centers, L.P., and/or DSE Hockey Club, L.P.’s, website or Facility website, and on other promotional materials. The Participant waives all potential claims and liabilities against the Releasees, relating in any way to the collection, use and disclosure of any of personally identifiable information on the internet, including compliance with the Federal Trade Commission's Children's Online Privacy Protection Act (COPPA) or any state or federal law or regulation, if applicable.
6) ARBITRATION. In further consideration of being allowed to participate in the Programs and/or to use the Equipment at the Facility, the Participant hereby agrees to submit any dispute arising from such participation to binding arbitration pursuant to American Arbitration Association (“AAA”) rules. Each party shall pay its own costs. Arbitration shall be commenced within one (1) year after the date on which any alleged claim first arose. The arbitration proceeding shall proceed exclusively in Dallas County, Texas, shall be governed by the Federal Rules of Evidence, and all parties agree to establish a reasonable and appropriate discovery schedule under AAA rules to expeditiously resolve this matter. Any court of competent jurisdiction may enforce the arbitration award.
7) The Participant understands that he/she is obligated to follow the rules of the Programs and that he/she has a duty to minimize his/her risk of injury through the exercise of common sense and by being aware of his/her surroundings.
8) If, while participating in the Programs, the Participant observes any unusual hazard, which he/she believes jeopardizes his/her personal safety or that of others, he/she will remove himself/herself from participation in the Programs and has an obligation to immediately bring said hazard to the
attention of the Facility.
9) ENTIRE AGREEMENT. In entering into this Agreement, Participant agrees that Participant is not relying upon on any oral or written representations other than what is set forth in this Agreement. This Agreement is the complete and final record pertaining to my participating in, association with, involvement of any type in the aforementioned Programs. As such, any and all oral, written, or implied agreements in relation to Participant’s participation in the Programs are inapplicable.
10) SEVERABILITY. The invalidity of any provision of this Agreement shall not affect the enforceability or effectiveness of any other provision. If any provision of this Agreement shall be held void, invalid or inoperative, such event shall not affect any other provisions herein which shall continue and remain in full force and effect as though such void, invalid or inoperative provision had not been a part hereof.
11) BINDING EFFECT. In the event of my death or incapacity, this Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns, and representatives.
I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I MAY BE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
Parents or Guardians must also sign if the Participant is UNDER 18.
Children’s Health StarCenter & Comerica Center’s Social Media Statement
The Children’s Health StarCenters and Comerica Center understands and appreciates the importance of
social networking to those who use our facilities and respects the individual right to freely express views
publicly. Social media provides unique opportunities for networking and promotion; however, it also
provides an unsupervised medium for inappropriate conduct to occur. Such conduct may be detrimental
to the community ice rinks, its hockey leagues and skating programs, and not in the best interest of ice
sports across Dallas-Fort Worth.. The Children’s Health StarCenters and Comerica Center expects those
who use our facilities to conduct themselves in an appropriate and professional manner at all times.
Social media communications targeted towards our membership that are used to commit abuse or
misconduct (e.g., emotional, sexual, bullying, harassment, and hazing) are considered violations of
policies and will not be tolerated. The Children’s Health StarCenters and Comerica Center also abides
by the USA Hockey Social Media, Mobile and Electronic Communications Policy and the US Figure
Skating Social Media, Mobile and Electronic Communications Guidelines (each a “Policy” and together
the “Policies”). These Policies are designed to protect against harassment, bullying, and other
inappropriate conduct or behavior.
Social media outlets are periodically reviewed by the The Children’s Health StarCenters and Comerica
Center. Should we be made aware of or find a posting or postings on social media that are in violation of
this Social Media Statement or an applicable Policy, we reserve the right to take appropriate
enforcement action, including but not limited to, ejection from the facility and reporting violations in
accordance with the USA Hockey SafeSport Program Handbook or the US Figure Skating SafeSport
Program Handbook.

Parent / Legal Guardian Code of Conduct
The Dallas Stars Metro Hockey League believes strongly in the values of teamwork, sportsmanship and leadership through example. The League's overall goal of player development both on and off the ice relies heavily on our ability, as a group of families, to create and maintain a safe, fun and positive environment for our players.
The Dallas Stars organization is taking this opportunity to both ask for your support in this effort and to remind you that proper conduct and sportsmanship is expected of all families at all times.
As a parent / legal guardian of a child involved in the Dallas Stars Metro Hockey League, I agree to abide by and follow the rules of the guidelines below:
I will promote the emotional and physical well-being of the athletes ahead of any desire to win.
I will support and promote Fair Play by encouraging my child to play by the rules.
I will encourage good sportsmanship by demonstrating positive support for all players.
I will leave the coaching to the coaching staff. I will not undermine the coaches' authority by trying to be a coach instead of a parent.
I will provide support for coaches and officials working with the athletes to provide a positive experience for all. I understand that coaching is a difficult endeavor, and I will always give coaches the benefit of the doubt and treat them with respect.
I will never ridicule or yell at my child for making a mistake or losing a game. I understand that making mistakes is a key part of learning.
I will remember that children learn by example. I will applaud good plays by both my child's team and their opponents. I will not be critical of, or embarrass any player, including opposing players.
I will treat all players, coaches, officials, parents and spectators with dignity and respect in language, attitude, behavior and mannerisms. I understand that my behavior reflects on my child and on the Dallas Stars Metro Hockey League, and I will require the same of my child.
I will not question the official's judgment or honesty in public. I recognize that officials are trained in their field and were put in place to ensure that there is a safe environment for my child to participate in the sport of hockey.
I will never yell, taunt, threaten or inflict physical violence upon any player, coach, official, league representative, arena personnel or spectator at any youth hockey activity. I will refrain from the use of abusive or vulgar language, racial, ethnic or gender-related slurs at any time at the rink or any youth hockey function. I will support all efforts to remove verbal and physical abuse from youth hockey games.
I understand the importance of skill development. I will remember that practices benefit my child more than games and competition.
I will not question the level/division that my child and his/her team is placed in. I will remember that the DSMHL staff has made their decisions based upon the best interest of the League and its members, and I understand that no players will be permitted to change rinks once teams are announced.
I will adhere to the 24-hour rule, and I will wait 24 hours after my child's practice or game before making my complaint known. I will discuss all issues with the appropriate parties in a calm manner, and this will include all types of communication. First point of communication will be the Head Coach of my child's team, and second point of communication will be the Hockey Programs Coordinator/Manager of my Home Facility.
I will not go into the locker room / dressing room of an opposing team or obstruct their access to exit from said room or ice arena.
I will not go into the officials' locker room / dressing room or obstruct their access to exit from said room or ice arena.
I will not go onto the ice surface, throw any object onto the ice surface, into the player's bench area(s), or at another individual, and I will not pound or climb on the glass.
I will not deface or damage any property belonging to any individual, team, association, or arena.
I will not be involved in any activity that warrants the summoning of law enforcement officials.
I will not incite any person(s) to become involved in any of the above-listed behaviors.
I understand that by accepting the terms of this document, I am agreeing to abide by the Dallas Stars Metro Hockey League (DSMHL) Parent / Legal Guardian Code of Conduct Agreement. I understand that the Dallas Stars Metro Hockey League adheres to the "Three Strikes and You're Out" principle. Further, my failure to comply with this agreement will result in disciplinary action, up to and including expulsion from the Dallas Stars Metro Hockey League.
